Terms of Use

By using this website, you accept these Terms of Use and our Privacy Policy. We may modify these terms at any time, with changes taking effect once posted.

Liability of Content.

This website is for informational purposes only and does not constitute legal or other advice. We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We are not liable for any direct, indirect, special, or consequential damages arising from use of www.emailsoftwareinsights.com. Any material downloaded is at your own risk.

Liability for Links.

Our site contains links to third-party websites whose content is the responsibility of their respective owners. We had no indication of unlawful content at the time of linking and will promptly remove any link upon becoming aware of a violation.

Affiliate Links.

This website is mainly funded through affiliate commissions paid when a visitor becomes a paying customer of a partner provider. Our reviews remain independent and objective — we only recommend products we are convinced of. If you have concerns about a test result, please let us know.

Copyright.

All content on this site is protected by applicable copyright laws. Reproduction, distribution, or commercial use beyond the scope of copyright law requires prior written consent.

Privacy Policy

You can use our website without providing personal data. Where personal data is processed, we do so in line with the General Data Protection Regulation (GDPR) and applicable national law. While we apply technical and organisational safeguards, no internet transmission can be guaranteed fully secure.

2. Server logs.

When you visit our site, our servers automatically collect general data such as browser type, operating system, referring website, pages visited, date and time of access, IP address, and ISP. This data is used to deliver and optimise the site, ensure technical security, and assist authorities in the event of a cyber-attack. It is stored separately from any personal data you provide and is not used to identify you.

3. Cookies.

Our website uses cookies — small text files stored by your browser — to recognise returning visitors and improve usability. You can disable or delete cookies in your browser settings at any time. Some site features may not work fully if cookies are disabled.

4. Newsletter.

You can subscribe to our newsletter using the form on our website. We use a double opt-in process: a confirmation email is sent to verify the address. We store your IP, date, and time of registration to prevent misuse. Newsletter data is used only to send the newsletter, is not shared with third parties, and you can unsubscribe at any time via the link in each issue. Our newsletters contain tracking pixels that record opens and clicks to help us improve content; you can revoke consent at any time.

5. Contact and comments.

If you contact us by email or contact form, the data you submit is stored solely to handle your request and is not shared with third parties. If you leave a blog comment, your comment, chosen name, date, and IP address are stored and the comment is published; the IP is retained for security and in case of unlawful content.

6. Retention.

We store personal data only as long as needed for the purpose of collection or as required by statutory retention periods. Once no longer necessary, data is routinely erased or blocked.

7. Your rights.

Under the GDPR, you have the right to:

  • confirmation and access regarding your personal data;
  • rectification of inaccurate data;
  • erasure ("right to be forgotten");
  • restriction of processing;
  • data portability;
  • object to processing, including for direct marketing;
  • withdraw consent at any time;
  • not be subject to decisions based solely on automated processing;
  • lodge a complaint with a supervisory authority.

To exercise any of these rights, email us at contact [at] emailsoftwareinsights.com.

8. Legal basis.

We process personal data on the bases set out in Art. 6(1) GDPR: consent (lit. a), contract performance or pre-contractual steps (lit. b), legal obligations such as tax law (lit. c), vital interests (lit. d), or our legitimate interests (lit. f) — the latter being the operation of our business for the benefit of our staff and stakeholders.

9. Provision of data.

Providing personal data is sometimes required by law (e.g. tax) or contract. Where this is the case, we will inform you whether provision is mandatory and what the consequences of non-provision would be.

10. Automated decision-making.

We do not use automated decision-making or profiling.
